IV — GENERAL TERMS AND CONDITIONS OF SALE 1. Object These General Terms and Conditions of Sale govern all sales of services offered on the MonCuisinierPrivé.com website. They specify the respective rights and obligations of the platform, the Client and the Chef.

2. Connecting Clients and Chefs The introduction between a Client and a Chef through the platform does not constitute a sale. This service is provided free of charge. In practice, when a Client wishes to contact a Chef, the platform sends an email notification to both the Client and the Chef selected by the Client. This email contains each party's contact details, along with the information submitted by the Client through the contact request form. Following this introduction, the Chef is solely responsible for handling the Client's request, preparing a quotation and a proposed menu, and providing any other information or documents required for the Client to confirm the booking. The Chef is also solely responsible for arranging payment and delivering the culinary service. In the event of any complaint or dispute relating to the performance of the culinary service, the Client must pursue any claim directly against the Chef. Under no circumstances may the Client hold the platform liable, as the platform does not participate in the practical organization or delivery of the service.

3. Publication of a Chef Profile The publication of a Chef's profile on the platform does not constitute a sale. This service is provided free of charge.

4. Promotion / Advertising of a Chef Profile The platform's profile promotion and advertising features are provided as paid services. The terms of the promotional service are specified on the platform at the time of purchase, including the price, duration, and the applicable promotion terms. An order becomes final and binding only after full payment of the stated amount has been received. By making payment, the Chef acknowledges and accepts: - The promotion and visibility terms applicable to the selected promotional service; and - These Terms and Conditions. Unless otherwise specified in the selected promotional offer, the Chef's profile will be promoted immediately after payment has been received.

5. Mutual Obligations 5.1 Platform Obligations The platform agrees to: - Publish Chef profiles. - Connect Clients with the Chef of their choice via email. - Forward to the Chef the information provided by the Client in the contact request form (such as the requested date, number of guests, type of service, etc.).

5.2 Client Obligations The Client agrees to: - Provide accurate and truthful information when submitting a request to be connected with a Chef.

5.3 Chef Obligations The Chef agrees to: - Contact the Client to discuss and define all details of the requested service. - Prepare and provide a menu proposal and quotation. - Provide the Client with all information necessary to organize the service in a clear and transparent manner. - Take into account the Client's dietary requirements, including allergies and food preferences. - Comply with all applicable food hygiene and food safety regulations. - Deliver the service with discretion and maintain the confidentiality of all information relating to the service and the Client, without disclosing such information to any third party.

6. Guarantees, compliance and food safety The Chef guarantees the conformity of the dishes (identified allergens) and respects the hygiene rules (HACCP). In the event of proven poisoning linked to a service, the Chef assumes his civil and professional liability.

7. Insurance The Chef must hold professional liability insurance to cover their services. The platform also has its own professional liability insurance. This insurance is taken out with the insurer Allianz.

8. Complaints and mediation Any complaints should be sent to customer service by email at bonjour@moncuisinierprive.com and will be processed as quickly as possible (acknowledgment of receipt within 48 business hours, response within 14 days). If an amicable resolution fails, the Customer may refer the matter to a competent consumer mediator such as CM2C: https://www.cm2c.net/ If mediation fails, any potential dispute will fall under the exclusive jurisdiction of the commercial courts of Paris, France, EU.

9. Contractual data and proof Electronic exchanges (email, logs) serve as proof between the Parties. The platform retains the data necessary for the processing of disputes.

V — SAFETY, CHECKS AND QUALITY 1. Cooks Controls Chefs must provide certain supporting documents to join the platform: identity document, food hygiene certificates (HACCP or equivalent), proof of professional liability insurance. The platform may require additional checks (clean criminal record, references, etc.), spot checks, and audits.

2. Rating and Feedback System After each service, the Client and Chef can rate each other on the quality of the service and its execution. Repeated poor feedback triggers warnings, suspensions, or exclusion from the platform. The ratings also serve to present a highlighting algorithm for the most popular profiles.

3. Management of abuse and fraud The platform monitors suspicious behavior (repeated cancellations, fake profiles, disputed payments) and applies corrective measures including blocking the account and reporting to the authorities.

VI — DATA PROTECTION and INTELLECTUAL PROPERTY Our privacy policy and cookie management policy are set out in a dedicated section available here: https://www.moncuisinierprive.fr/en/privacy-policy This is in accordance with GDPR regulations.
